1. Acceptance of Terms
By accessing or using Content Creator Nexus ("the Platform", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and Content Creator Nexus. If you do not agree to all of these Terms, you must not access or use the Platform.
These Terms apply to all visitors, users, and others who access or use the Platform, whether in a free or paid capacity. Your continued use of the Platform following the posting of any changes to these Terms constitutes acceptance of those changes.
Age Restrictions: The Platform is not intended for children under the age of 13. You must be at least 13 years old to use the Platform. If you are between the ages of 13 and 17, you may only use the Platform with the express consent and supervision of a parent or legal guardian.
2. Description of Service
Content Creator Nexus is a digital platform designed to connect content creators, collaborators, brands, and audiences. Our services include creator profile creation, content hosting, collaboration tools, brand partnership matching, analytics dashboards, community features, and educational resources.
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, including the availability of any features, databases, or content, with or without notice.
3. Account Registration & Security
To access certain features of the Platform, you must register for an account. When registering, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials.
You agree to notify us immediately at legal@creatornexuspro.com of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that exhibit suspicious activity.
Each individual may maintain only one account on the Platform, unless expressly authorized in writing by Content Creator Nexus.
4. User Responsibilities
As a user, you agree to provide truthful information, comply with all applicable laws, respect intellectual property rights, maintain professional conduct, and refrain from impersonation. Content creators are responsible for the accuracy of their portfolio content and representations made to brands.
5. Prohibited Activities
The following activities are strictly prohibited and may result in account termination:
- Posting illegal, defamatory, or otherwise objectionable content
- Harassment, abuse, bullying, or threats
- Spam and unsolicited commercial messages
- Scraping or automated data collection without authorization
- Reverse engineering or attempting to derive source code
- Creating fake accounts or fabricating reviews
- Uploading malware or malicious code
- Circumventing payment systems
- Fraudulent brand partnership claims
- Violating third-party privacy rights
6. Content & Intellectual Property
Your Content: You retain full ownership of all content you create and upload. By posting, you grant Content Creator Nexus a non-exclusive, worldwide, royalty-free license to use your content in connection with operating and improving the Platform.
Our Content:The Platform's name, logo, branding, software, and all associated intellectual property are owned exclusively by Content Creator Nexus and protected by law.
7. Data Usage & Privacy
We collect personal data as described in our Privacy Policy. We use personal data for providing services, personalizing your experience, processing transactions, communicating updates, and detecting fraud. We do not sell your personal data to third parties.
8. Third-Party Services & Links
The Platform may contain integrations with third-party services. We are not responsible for their content, privacy practices, or reliability. Brand partnerships are agreements between you and the respective brand, with Content Creator Nexus acting solely as a facilitator.
9. Payments & Fees
Certain features may require payment. All fees are in USD and non-refundable unless explicitly stated. We may modify pricing with 30 days' notice. Filing chargebacks without resolution attempts may result in account suspension.
10. Disclaimers
THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES.
WE MAKE NO GUARANTEES REGARDING EARNINGS, INCOME, BRAND DEALS, SPONSORSHIPS, OR ANY COMMERCIAL OUTCOMES.
11. Limitation of Liability
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY TO YOU DOES NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.
12. Indemnification
You agree to defend, indemnify, and hold harmless Content Creator Nexus from claims, damages, or losses arising from your use of the Platform, violation of these Terms, misrepresentations, or any content you submit.
13. Termination
We may suspend or terminate your account at any time for any reason. You may terminate your account through your account settings. Upon termination, your access rights immediately cease.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Oklahoma, United States. Disputes shall first be addressed through good-faith negotiation within 30 days.
Binding Arbitration: If not resolved, disputes proceed to binding arbitration in Oklahoma, administered by the American Arbitration Association.
Class Action Waiver: You waive any right to participate in class action lawsuits or arbitration.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes take effect 14 days after notice. Continued use constitutes acceptance.
